INFORMATION FOR THE PROCESSING OF PERSONAL DATA

(Article 14 of the European General Data Protection Regulation "GDPR")

In the frame of our statutory activity, namely the development of a real estate network in Greece with the franchise system, under the trademarks and distinctive features of RE/MAX INTERNATIONAL, we process your personal data (hereafter "Data"), which are made known to us by you in any way or provided to us by our network offices and their associated Real Estate Consultants / Sales Associates, who have received this data from you and transmit and disclose it to us only after your consent. Your Data refers to your name, address, contact details, and any other data you have notified to our network office and/or Real Estate Consultant/Sales Associate partnering with our network.

 

A. Legal basis and purposes of your Data processing

- Why do we use your Data?

 

We use your Data in order to:

 

  • Respond to your requests for giving you any information regarding our providing services.
  • Process any complaints.
  • Create, secure and support our customer data base and its analysis (including the retention of our list of leads through updates).
  • Send to you Newsletters, SMS or VIBER SMS regarding our company’s news, offers and promotional activities.
  • Understand and analyze the results of our advertisements and promotional activities.
  • Comply with your rights regarding your Data.
  • Secure transactions.
  • Make business analysis and improvements in our business activities and services, such as the provision of our services in the market and their improvement, and any improvement in your customer experience.
  • Conduct market researches, analytics, develop marketing strategies and manage marketing campaigns (including the collection of website traffic statistics).
  • Detect, prevent and confront fraud or any other illegal activities.
  • Check the quality and the best business practices that are provided by our franchised network in Greece, under the trademarks and distinctive features of RE/MAX INTERNATIONAL.
  • Protect rights and our or third parties’ assets.
  • Other purposes: we may use your Data in another way: In this case we shall provide specific notifications to inform you that we collect your Data and we shall ensure to get your consent when this is necessary before any processing.  

 

-Legal basis of your Data processing:

 

RE/MAX Greece relies on four legal basis when processes your Data, which are the followings:

 

  • Execution of a contract:when the processing of your Data is necessary for the fulfillment of our obligations that resulting from a contract.
  • Legal obligation: when we are obliged to process your Data in order to comply with a legal obligation, such as to keep records for tax reasons or to provide a public body or an authority that enforces the law with any information needed.
  •  Legitimate Interest: we may process personal data concerning you when we have a legitimate interest during the execution of a lawful activity, so as to ensure the subsequence of this activity, provided that the latter will not outweigh your interests.
  • Your consent: we may occasionally ask for your specific consent in order to process some of your Data. The processing of your Data will take place only if  you agree. You could withdraw your consent at anytime, without a retroactive effect, by sending us an email to info@remax.gr.

 

- Who are the indicative recipients of your Data:

 

As far as this is necessary for the execution of a contract, the fulfillment of its legal obligations, the servicing of its legitimate interests and in cases that RE/MAX Greece has received your consent, indicative recipients of your Data may be the following:  

 

  • The responsible employees and the directors of RE/MAX Greece, and provided that all  specific legal conditions are fulfilled, our franchisor, PMSCS REAL ESTATE FRANCHISING, INC., Alpenstrasse 15, Postfach 7863, CH-6302, Zug, Switzerland (“RE/MAX Europe”), as well as RE/MAX Europe’s other franchisees and their respective franchisees.
  • RE/MAX network offices in Greece.
  • Οther IT service providers that we use.
  • Telephone assistance and call center services providers.

 

Some of the recipients referred to above are located in or process personal data outside of your country. The level of data protection in another country may not be equivalent to that in your country. However, RE/MAX Greece only transfers your personal data to countries where the EU Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients provide an adequate level of data protection.

 

B. Security and Retention of your Data

 

We retain your Data as long as it is necessary for the purposes of data processing, namely during the term of our contract, of your consent, of our legal obligations (e.g. the retention for tax reasons) and of our legitimate interest in each case.

The procedure of data processing is conducted in such way that its privacy is ensured. RE/MAX Greece implements adequate technical and organisational measures, so as the appropriate level of security of your Data against risks by accidental or unlawful destruction, accidental loss, unauthorised alteration, disclosure or access and any other unlawful forms of processing, is ensured.

The Data that are provided to us by you is protected by appropriate information security techniques which ensure both its secure transition via web and its secure retention in Information Systems.

We demand that all third parties that may receive your Data shall implement the appropriate technical and business security measures for your Data protection, according to the Greek and European legislation for personal data protection.

 

C.Rights and remedies

 

Your rights according to the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation) are the followings:

 

  • Right of access to your Data that we are processing.
  • Right to rectificationof deficient or inaccurate personal data concerning you that RE/MAX Greece retains.
  • Right to erasure of your Data.
  • Right to restriction of Data processing.
  • Right to Data portability to you or to third parties. You could receive the personal data concerning you in a structured, commonly used and machine-readable format and transmit those Data, under legal conditions, to another controller, provided that it will not affect adversely third parties’ rights and freedoms (only for automated processing of information you provided us by giving your consent or for the execution of the contract between us).
  • Right to object at any time to processing of your Data. RE/MAX Greece may not comply with that right, since it demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.
  • Right to withdraw your consent at any time. In this case,the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
  • Right to lodge a complaint with the Hellenic Data Protection Authority (www.dpa.gr), if you believe that your rights have been infringed in any way (right to lodge a complaint with the Authority).
